Antitrust Lawsuit Involving Multifamily Owners and Managers Continues

In November 2022, several U.S. multifamily tenants filed a lawsuit against numerous real estate companies alleging improper use of RealPage software to drive up rent costs for multifamily tenants. Recently, my colleague, John Green, posted about these lawsuits. As MMM continues to monitor the lawsuit, I wanted to share this article, which explores the variety of motions to dismiss that have been filed on behalf of the defendants. These motions could prevent the case from moving forward for reasons such as failure to state a claim, plausibility, and lack of personal jurisdiction.

Most of the landlords said the consolidated class action fails to allege a plausible conspiracy involving the use of lease rent options, which is preempted by antitrust laws.
